KAVEXA PROPERTY SERVICES – Terms and Conditions

Western Australia | Version for review dated 18 October 2026

1 Business and application

These terms govern services supplied in Western Australia by AJSS DEVELOPMENTS PTY LTD trading as KAVEXA Property Services (KAVEXA, we, us). The customer identified in the quotation is you. Our quotation must identify the contracting entity, ABN, contact details and any registration required for the work.

These terms apply only when provided to you before acceptance and incorporated into your agreement. Browsing our website alone does not create a service contract. A listing of a service does not mean it is included in your job.

Mandatory law prevails. Subject to that law, a job-specific signed contract and its expressly agreed special conditions prevail over an inconsistent quotation, and the quotation prevails over these general terms. These terms supplement, and do not replace, a required statutory home building contract or notice.

2 Services and scope

We provide painting and decorating; epoxy flooring and protective coatings; concrete grinding, honing and surface preparation; wall and floor tiling; plasterboard patching and wall repairs; wallpaper removal; timber and deck staining or varnishing; and pressure washing or related surface cleaning, where included in our quotation.

Minor partitions, fit-out work, masonry repairs, roof coating, waterproofing or other additional work are included only if expressly quoted and the required competence, registrations, insurance and approvals are in place. Electrical, plumbing, gas, structural engineering and asbestos removal work are excluded unless separately arranged with appropriately authorised providers.

The quotation must state the site, areas, quantities or measurement basis, preparation, products or coating system, finish, inclusions, exclusions, price, payment stages and anticipated timing. Unlisted surfaces, concealed areas, furniture removal and repairs to underlying leaks or structural faults are excluded unless agreed.

3 Quotations and prices

A fixed quotation remains open for acceptance for 30 calendar days from issue unless it states another period.

An estimate is an indicative assessment, not a fixed price; we will identify its assumptions and agree a price or charging basis before work proceeds.

Prices are in Australian dollars. The quotation will show GST where applicable and the total payable. Consumer-facing prices will include GST and other unavoidable charges. Any provisional sum, allowance, hourly rate or measurement adjustment must be clearly explained before acceptance.

An accepted fixed price will not increase simply because our costs rise. Changes require agreement and must be permitted by applicable law. We will not substitute products or reduce the agreed scope without your approval.

4 Acceptance and contract documents

You may accept in writing, including email or our quotation system, once you have received the quotation and these terms. Where law requires dated signatures, prescribed notices or a particular contract form, those requirements must be completed before we proceed. Payment does not cure missing statutory documents.

An agent must disclose the owner and confirm their authority. The quotation will identify who is responsible for payment. We retain the accepted version of the quotation and terms and provide you with a copy. Website updates do not retrospectively change an existing agreement.

5 Deposits and payment

The deposit and payment stages are stated in your quotation or signed contract. For a fixed-price home building work contract covered by the Home Building Contracts Act 1991 (WA), valued from AU$7,500 to AU$500,000, the deposit will not exceed 6.5% of the total contract price. No higher general deposit term overrides that limit.

Where that Act applies, subsequent payments will relate only to work actually performed or materials already supplied, subject to the Act. A booking fee, material payment or other label will not be used to avoid restrictions on advance payments. Any required home indemnity insurance must be arranged before payment or commencement.

For other jobs, any deposit must be disclosed, reasonable and agreed before acceptance. It is credited against the contract price and is not automatically non-refundable.

Unless the signed contract states otherwise, properly issued invoices are due within seven calendar days. Final payment follows practical completion, subject to any lawful right to withhold or dispute an amount. Tell us promptly about an invoice error; we will explain the calculation and seek to resolve it. Nothing removes statutory payment, set-off, adjudication or dispute rights.

No late interest, collection fee or legal cost is automatically imposed by these terms. Any recovery must be lawfully recoverable and reasonable. We do not use pay-when-paid arrangements where prohibited.

6 Variations and unexpected conditions

If you request a change, or we identify concealed damage, moisture, weak concrete, contamination, incompatible coatings or other unexpected conditions, we will explain the issue and proposed solution. A variation must describe the changed work, price or calculation basis and time effect.

We obtain written agreement before variation work begins. Where required by the Home Building Contracts Act, the variation must be dated and signed by both parties and a copy given to you before work starts. Urgent protective work or statutory exceptions will be handled only as the law permits, with prompt notice and records.

If a suitable solution is not agreed, we will secure the affected area and discuss rescheduling, a reduced scope or lawful termination. We will not conceal a known defect or apply a system we reasonably consider unsafe or unsuitable.

7 Site access and preparation

You must arrange authorised access during agreed hours, advise us of site rules and known hazards, and provide any water, electricity, parking or clear work area specified in the quotation. Tell us about alarms, concealed services, fragile surfaces, previous treatments and known asbestos or lead hazards.

Please remove valuables, personal items and movable furnishings from the work area where agreed. We will take reasonable care with masking, protection, handling and security. We remain responsible for damage caused by our failure to exercise due care and skill.

Keep children, pets and unauthorised persons outside marked work zones and follow reasonable safety instructions. We remain responsible for our own safety duties and will coordinate with other duty holders. Neither party transfers its legal duties to the other.

8 Safety and hazardous materials

We will assess risks, use appropriate controls and comply with applicable work health and safety duties. Work may pause immediately where needed to address an imminent risk; we will explain what is needed to restart safely.

If suspected asbestos, lead contamination or another hazardous material is found, affected work will stop pending appropriate assessment and a safe method. Asbestos cement must not be high-pressure cleaned.

Hazardous-material testing, removal or remediation is excluded unless expressly quoted and lawfully arranged.

We will manage dust, fumes, ventilation, chemicals, noise and waste for our work. Any additional work or cost arising from hazards is subject to clause 6; discovery is not an automatic entitlement to an extra charge.

9 Painting and decorative finishes

The quotation specifies the surfaces, preparation and coating system. We will use suitable preparation and compatible products, follow applicable requirements and manufacturer instructions, and apply good trade practice. Coat numbers alone do not determine adequacy; required coverage, application rates and drying conditions also matter.

Please approve colour, sheen and any agreed sample before ordering or application. Screens and small samples may differ from larger finished areas. We will identify known limitations, such as existing texture, patch visibility, repaired areas, staining or colour coverage, before agreeing the finish.

Painting does not by itself repair water ingress, rising damp, structural movement or widespread substrate failure. Necessary treatment must be agreed before coating. Such conditions do not excuse inadequate inspection, preparation, advice or application by us.

10 Epoxy coatings and concrete preparation

Before coating, we will assess the substrate and carry out the testing required by the selected system and site conditions. The agreed specification will address preparation, moisture, contamination, soundness, repairs, primers, coats, application conditions and curing.

The quotation must identify whether crack repairs, moisture mitigation, levelling, joint treatment, flake coverage, UV-resistant topcoats and slip-resistance testing are included. Epoxy is not a structural repair or waterproofing membrane unless the specified system is expressly designed and agreed for that purpose.

Grinding or honing may expose variable aggregate, existing repairs and colour differences. We will explain the likely finish and any sample or inspection basis. We will not promise uniform aggregate exposure or a particular gloss without an agreed specification.

Where slip performance matters, we will agree the intended use, texture and required classification or testing before installation. No coating is represented as slip-proof. We will give written restrictions for foot traffic, vehicles, water, chemicals and heavy loads based on the installed system and actual conditions.

11 Tiling and wall repairs

Tiling scope must identify substrate preparation, layout, tile type, adhesive, grout, movement joints, falls and finishing details. We will raise unsuitable substrates or failed existing waterproofing before covering them.

Tiling and grout alone do not establish a waterproof assembly.

Waterproofing is included only if expressly stated, with the system, responsible installer, preparation, inspections and records identified. Plumbing, drainage changes, structural alterations and electrical work require separate arrangements with authorised providers where applicable.

For plasterboard and wall repairs, the agreed finish, extent of repair and lighting conditions must be recorded. Localised patching may differ from an entire wall finish; this does not reduce our obligation to meet the agreed standard. Partition work requires a job-specific assessment of approvals, fire, acoustic, structural and service requirements.

12 Timber coatings and pressure washing

Timber coating work depends on condition, moisture, previous finishes and exposure. The quotation will state preparation and the coating system. We will give relevant maintenance advice; no fixed service life is promised unless expressly agreed on a supported basis.

Pressure washing requires a suitable method for the substrate and reasonable protection of openings, electrical equipment, adjoining property and drainage. We will manage contaminated runoff and waste lawfully. Pre-existing deterioration does not exclude responsibility for damage caused by an unsuitable method or lack of care.

13 Timing and delays

We will state anticipated start and completion dates and identify any binding dates in the contract. Weather, drying or curing, access problems and material availability may affect timing. We will notify you promptly of a delay, its cause and likely duration, take reasonable steps to minimise it and agree revised arrangements as required.

A delay does not automatically permit extra charges. Any extension, cost change or termination must comply with the contract and law. Your rights where services are not supplied within an agreed or reasonable time are preserved.

14 Cancellation and rescheduling

Tell us as soon as practicable if you need to cancel or reschedule. We will try to agree a workable new date.

Statutory cancellation, cooling-off and refund rights take priority; these terms do not impose charges for exercising those rights.

If you cancel for convenience, we may seek only a lawful, reasonable amount reflecting work properly completed and actual unavoidable costs caused by the cancellation, with evidence and no double recovery.

We will take reasonable steps to reduce loss, return or reuse materials and refill the booking. No automatic flat cancellation penalty or forfeiture of the full deposit applies.

We will provide an itemised reconciliation, credit payments already received and refund any balance owed to you promptly. If we cancel without your breach, we will refund payments for undelivered work and address any further remedy required by law.

15 Suspension and termination

For a material breach, either party may give written notice describing the breach and a reasonable opportunity to remedy it, unless immediate action is lawfully justified. Any suspension or termination must comply with applicable statutory notice and procedure requirements.

We will not suspend solely to pressure you over a genuinely disputed amount without considering the dispute and applicable legal rights. On termination, we will leave the site reasonably safe and account for completed work, supplied materials, payments and refunds. No clause authorises entry without permission or removal of installed finishes.

16 Completion and defects

We will offer a completion inspection and record outstanding items, agreed rectification and care instructions.

Practical completion means the agreed work is substantially complete and usable for its intended purpose, subject to curing restrictions and minor items that do not prevent that use.

Please report concerns promptly with the site address, job reference, description and available photos. Allow reasonable access to investigate and carry out any remedy required by law. Urgent safety measures and your rights to other lawful remedies are unaffected.

Inspection, payment, occupation or signing a handover does not waive latent defects or statutory rights. There is no 48-hour claim cut-off. Any statutory defect notification or rectification obligation continues to apply.

17 Consumer guarantees and liability

Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Services must meet applicable guarantees of due care and skill, fitness for a disclosed purpose where applicable, and supply within a reasonable time if no time is fixed.

Where work or supplied goods fail to meet a consumer guarantee, remedies will be provided as required by law. These may include rectification, repair, replacement, cancellation, refund or compensation, depending on the circumstances. You do not have to rely only on a manufacturer or its warranty.

We do not exclude all consequential loss or cap all liability at the amount paid. Liability, causation and recoverable loss are determined under applicable law. Wear, misuse, third-party damage and underlying defects are relevant only to the extent they actually cause the problem; they do not remove responsibility for our own breach.

Any additional voluntary warranty must be separately documented with its coverage, period, claim process, expenses, provider details and legally required wording. These general terms do not introduce a separate fixed-term warranty against defects or reduce any existing promise or statutory protection.

18 Subcontractors and insurance

We may use suitably competent subcontractors and will obtain required registrations or licences for the work. Where you contract with us, using a subcontractor does not remove our contractual or statutory responsibilities.

Applicable insurance, including workers compensation where required, must be maintained. We will provide evidence of relevant cover on reasonable request. Home indemnity insurance is assessed for the particular work and applicable exemptions; it is not represented as automatically required for every painting or tiling job.

19 Records privacy and photographs

We use contact details and job records for quotations, delivery, billing, safety and resolving issues, with reasonable safeguards and disclosures needed to perform the work or meet legal duties. Our separate privacy notice should explain relevant service providers and data handling.

We may take proportionate job-condition photographs with your knowledge, avoiding unnecessary personal information. Identifiable people, addresses, personal belongings or interiors will not be used for marketing without separate informed permission. Consent to marketing is optional and is not a condition of service.

20 Website communications and disputes

Website descriptions are general information; the agreed quotation defines your job. You must not misuse the website, submit unlawful material or interfere with its operation. Our original website content remains subject to applicable intellectual property rights. Third-party links do not remove our responsibility for our own representations.

Send job, invoice or workmanship concerns to admin@kavexapropertyservices.com.au or the contact shown on your quotation. We will acknowledge and investigate complaints within a reasonable time and try to resolve them directly.

Either party may seek assistance from WA Consumer Protection, Building and Energy, an appropriate tribunal or court, or a statutory adjudication process where available. This clause does not require you to complete private mediation or waive statutory rights before seeking urgent or other lawful relief.

Western Australian law governs work under these terms, subject to mandatory law and any forum rights that cannot be excluded. An invalid provision is severed only to the extent permitted by law. Any agreed change to an existing contract must be recorded in writing.
